For instance, a doctor may diagnose an internal infection and prescribe a round of antibiotics to fight it. However, that antibiotic may have severe undisclosed side effects.
In rare cases, a medication’s side effects could cause serious injuries, or even death. Note, however, that liability is often difficult to prove in these cases.
For one thing, there may be other underlying medical issues that cause the same side effects as the drug. For instance, a drug may cause liver failure in some patients, but if the patient had existing liver issues due to alcohol consumption, causation can be difficult to prove.
Sometimes the underlying issues do not even need to be directly linked to the side effects to undermine the potential legal case. Rather, a history of significant morbidity (sickness) may in itself weaken the case.
